System Galerii Terms of Service
1. Definitions
For the purposes of these Terms, the following definitions apply:
1.1. Platform: the SystemGalerii.pl service (including apps and API) for managing, sharing and selling access to photo galleries.
1.2. Provider: MGSupport Michał Grycz (mgsupport.pl), operator of the Platform, VAT EU: PL7622026496, REGON: 542850948, address: ul. Brzozowa 14, 07-207 Rząśnik, Poland, contact: kontakt@systemgalerii.pl (kontakt@mgsupport.pl), phone: +48 453 653 831.
1.3. Photographer: a natural person running a business, a legal person or an organisational unit using the Platform to create and share galleries.
1.4. Client: a person browsing a Photographer’s galleries or purchasing digital products (e.g. photo access) offered by the Photographer.
1.5. Account: an individual user account on the Platform. Content: photos, texts, gallery settings and other materials uploaded by the Photographer. Terms: this document.
2. General provisions
2.1. These Terms set out the rules for electronic services and use of the Platform by Photographers and Clients.
2.2. Use of the Platform is voluntary. Creating an Account and starting paid services means acceptance of these Terms.
2.3. The Provider delivers services according to the current Platform features and information on the Pricing page.
2.4. Personal data processing is governed by the Privacy Policy.
3. Registration and Account
3.1. To use Photographer features, you must create an Account with accurate data and protect access with a strong password.
3.2. Sharing login credentials with third parties is prohibited.
3.3. The Photographer must keep Account data up to date (especially billing and contact details) and protect the Account against unauthorised access.
3.4. The Provider may refuse registration or request verification if there is a reasonable suspicion of a legal or Terms violation.
4. Rules of use
4.1. The Photographer must use the Platform for its intended purpose, in line with law and fair practice.
4.2. In particular, it is prohibited to:
- publish unlawful, offensive, discriminatory content or content violating personal rights,
- infringe copyrights, trademarks or likeness rights without required consent,
- bypass security, scan for vulnerabilities or overload the Platform,
- use the Platform for spam, phishing or deceptive practices,
- resell Account access contrary to these Terms.
4.3. The Photographer is fully responsible for Content in their galleries and for how it is shared with Clients (passwords, links, expiry).
4.4. The Provider may moderate, restrict or remove Content that violates law or these Terms and, where justified, suspend the Account.
5. Galleries, Content and Clients
5.1. The Platform enables creating galleries, managing photos, sharing them with Clients and, depending on the plan, selling access or digital products.
5.2. The sale relationship between Photographer and Client is concluded directly between them. The Provider supplies the technical infrastructure and, where applicable, Stripe payment processing.
5.3. The Photographer must clearly inform the Client about offer terms (including withdrawal rights, if applicable) before completing an order.
5.4. Clients viewing publicly shared galleries must respect copyright and must not copy protected materials without authorisation.
6. Copyright and licences
6.1. The Photographer retains all copyright and related rights to Content uploaded to the Platform, to the extent they lawfully hold them.
6.2. By uploading Content, the Photographer warrants they hold the necessary rights and consents (including likeness, where required) and that Content does not infringe third-party rights.
6.3. The Photographer grants the Provider a non-exclusive, royalty-free licence to host, technically process (e.g. thumbnails, CDN) and display Content solely to provide Platform services.
6.4. The Client obtains download or use rights only as stated in the Photographer’s offer / purchased product. Lack of purchase does not authorise copying protected materials.
7. Plans, payments and subscriptions
7.1. Photographer access is provided under plans described on the Pricing page. Features, limits and prices may vary by plan.
Payments
Subscription payments and, if enabled, Client orders are processed by Stripe.
The Provider does not store full payment card numbers.
7.2. Subscriptions renew automatically for the next billing period unless cancelled before the end of the current period in the Account panel or with the payment operator.
7.3. Cancelling a subscription does not refund fees for a started billing period, unless law, the offer terms or the Provider’s consent state otherwise.
7.4. After a failed payment, the Provider may limit access to paid features until amounts due are settled, after prior notice.
7.5. Invoices are issued based on Account data. The Photographer is responsible for their accuracy.
8. Withdrawal and complaints
8.1. Consumers have rights under consumer law, subject to exceptions for digital content supplied with express consent before the withdrawal period ends.
8.2. Complaints about Platform operation should be sent to kontakt@systemgalerii.pl, describing the issue and, if possible, Account details and when it occurred.
8.3. The Provider handles complaints within 14 days of receiving a complete submission and notifies the result by e-mail.
8.4. Complaints about a Photographer's offer (photo quality, licence scope, file delivery) should first go to the Photographer. The Provider may assist technically without assuming responsibility for the offer content.
8.5. Consumers may use out-of-court dispute resolution procedures (ADR), in particular via regional Trade Inspection authorities (Inspekcja Handlowa), permanent consumer arbitration courts, municipal or county consumer ombudsmen, and the UOKiK information portal (polubowne.uokik.gov.pl). 9. Suspension and termination
9.1. The Photographer may stop using the Platform and delete the Account via panel features at any time (subject to legal retention duties, e.g. invoices).
9.2. The Provider may suspend or terminate services for an Account that violates these Terms, the law or Platform security, notifying the Account e-mail where possible.
9.3. After subscription expiry, Account data (galleries, photos) remains accessible for 30 days, after which the Provider may delete it. The Photographer should export data before this period ends. Account deletion by the Photographer triggers immediate loss of access.
10. Liability
10.1. The Provider uses due care to keep the Platform stable and secure but does not guarantee uninterrupted, error-free availability (including maintenance windows or third-party outages).
10.2. The Photographer is responsible for Content, Client relationships and legal compliance of their activity (including taxes and copyright).
10.3. To the fullest extent permitted by law, the Provider’s liability to a Photographer (who is not a consumer) is limited to subscription fees actually paid in the 12 months preceding the event.
10.4. Liability limits do not exclude liability for intentional damage, for lack of due care toward consumers where required by law, or in other cases where exclusion is legally impermissible.
11. Personal data protection
11.1. Personal data, cookies and user rights are governed by the Privacy Policy.
11.2. Where the Photographer processes Client data in their galleries, the Photographer acts as controller of that data and must meet GDPR duties toward Clients.
11.3. With respect to Client personal data entrusted by the Photographer, the Provider acts as a processor under Art. 28 GDPR. The Data Processing Agreement (DPA) is available for download in the Photographer Account panel (Settings → Privacy & GDPR).
12. Final provisions
12.1. The Provider may amend these Terms. Photographers will be notified of material changes at least 14 days in advance (e-mail or in-panel notice). Continued use after changes take effect means acceptance, unless law provides otherwise.
12.2. Matters not covered are governed by Polish law. Court jurisdiction follows applicable law; for consumers, protective rules apply.
12.3. If any provision is invalid, the remaining provisions stay in force.
